The FAPE standard is a right that requires school districts provide educational programming, services and placement that are designed to meet the child's unique needs so that the child may make measurable gains within a year's time.
If your child is determined to be eligible for special education services by your school district following a thorough assessment, then he or she may be entitled to either a Section 504 plan or an Individualized Education Program (IEP).
If you and your school district cannot agree on appropriate programming, placement, services or special education eligibility, state and federal law allow the parent of a child with special needs to file for an administrative proceeding referred to as "due process."

In-Home Support Services (IHSS) is a statewide program administered by each county under the direction of the California Department of Social Services.
The IHSS Program helps pay for services provided to low-income elderly, blind or disabled individuals, including children, so that they can remain safely in their own home. IHSS is considered an alternative to out-of-home care, such as nursing homes or board and care facilities.
Some of the services that can be authorized through IHSS include: housecleaning, meal preparation, laundry, grocery shopping, personal care services (such as bowel and bladder care, bathing, grooming and paramedical services), accompaniment to medical appointments, and protective supervision for the mentally impaired.
Consumers of IHSS support services may appeal any denial or reduction in hours and services, including a refusal to allow the full number of hours the consumer feels they need. The consumer also has a right to appeal a Share-of-Cost (SOC) determination (a decision asking that the consumer pay a share of the cost of in-home care because his/her income is above the SSI threshold.)
Since there are short deadlines to request an appeal, it is important to hire an attorney to preserve your rights when you are notified of a reduction or of any change to your IHSS hours.
